Fred Berfune

Can anyone file an amicus brief to support you, Orly? I’ve written a 114 page brief, but I don’t know if they take them from private citizens. How many copies should I make?

Answer

You need to have 40 copies for the court and one copy for the Solicitor General. You can download the rules of the court in regards to font and page layout. I had it printed by the professional printer.

I am not sure if they will accept an Amicus from a lay person. I saw an amicus from a law student accepted by the court. A law student is not a licensed attorney. Logically speaking, if they accepted an amicus from a law student (legally a lay person, not a licensed attorney) they should accept one from you as well, but logic and Constitution have not been the guiding light of Federal courts for some time now.

Very important

    Mr Berfune:

To submit an amicus brief you need to follow Rule 37 in this link https://www.supremecourt.gov/ctrules/2010RulesoftheCourt.pdf.

The Supreme Court Rules cover this. There is no difference between a lawyer and a non-lawyer as long as the non-lawyer is only representing themself. You need to familiarize yourself with the entire set of Rules as they govern length, amount of words, pagination, number of copies, who gets one, etc. Simply sending 40 copies gets you the circular file. I could be wrong, but excluding attachments, your brief is limited to 6000 words.

Also bear in mind that amicus briefs must be submitted no later than 30 days after the case is docketed. You could perhaps file a motion to extend the time, but given the fact that the conference is scheduled for January 7, 2011 – you are probably out of luck.

You would also want to file in forma pauperis or you will need to have a professional service publish the brief. To file in forma pauperis, you would need to file a motion, which is explained in the rules.

Not sure if my message went through.

Have Orly direct you to the Supreme Court rules, and follow all of the instructions shuch as: brief length (for an amicus you have a max of 6000 words), when it is to be filed (within 30 days after docketing), and other things such as filing a motion for leave to file brief, filing in forma pauperis (to avoid making 40 copies by a professional brief publisher using correct colors, typeset, etc).

Orly should be able to direct you to all of this rules. Failure to follow any rule generally gets the brief ignored. You will need a very good argument for why you should be able to file so late in the game.

You couldn’t keep the simple truth shorter than that? Good grief…
