The Army filed formal charges against Lt. Col. Terry Lakin, a military physician who refused to deploy to Afghanistan because he believes President Barack Obama hasn’t proven that he was born in the U.S.
The decision to initiate potential court-martial proceedings against Col. Lakin represents a line in the sand for the Army, which declined to discipline a pair of officers who raised similar questions last year about Mr. Obama’s constitutional eligibility to serve as commander in chief.

Chuck Dasey, a spokesman for Walter Reed Army Medical Center in Washington, said Col. Lakin was being charged with three counts of disobeying a lawful order and one count of dereliction of duty. If found guilty, Col. Lakin could be kicked out of the Army, forced to give up his retirement benefits and jailed for up to four years.
Col. Lakin and his attorney didn’t respond to phone messages or emails seeking comment. In a statement released through the foundation raising money for his legal-defense fund, the officer said he was prepared to press his case in court.
“I invited my court martial, and today I stand ready to answer these charges,” Col. Lakin said. “I was prepared to deploy if only the president would authorize the release of the proof of his eligibility. He refused, and now the court will determine the issue, and my fate.”
The White House long ago stopped commenting on issues about the president’s citizenship.
The military’s decision to pursue disciplinary measures against Col. Lakin, a doctor at Walter Reed, is likely to turn his case into a cause célèbre for certain elements of the political right. Conservative figures such as G. Gordon Liddy have rallied behind Col. Lakin and urged their supporters to contribute to his legal-defense fund.
The officer and his attorney, Paul Jensen, have hinted that they will use the discovery process to seek to compel Mr. Obama to release a more detailed birth certificate. That could turn his eventual military trial into a pivotal moment for the “birther” movement, which believes Mr. Obama was born in Kenya rather than Hawaii despite voluminous evidence to the contrary.
Col. Lakin went public with his doubts about Mr. Obama last month in a YouTube video that detailed the officer’s decision to disobey what he described as “illegal orders” that he deploy for a second tour in Afghanistan.
“Any reasonable person looking critically at the evidence currently in the public domain would have questions about President Obama’s claim to be a natural-born citizen,” Col. Lakin said in the short video, which has been viewed more than 181,000 times.
A wide array of public officials from Hawaii—including its Republican governor—have attested that Mr. Obama was born in the state, and the Obama campaign released a copy of his Hawaiian birth certificate during the 2008 presidential campaign.
That hasn’t been enough to kill the false rumors about Mr. Obama’s provenance. In a New York Times/CBS News poll earlier this month, 20% of the respondents thought the president was born overseas and 23% said they didn’t know for sure.
The Lakin case has attracted enormous attention within the military because of the officer’s rank and prominence. An 18-year veteran, Col. Lakin was recently selected for promotion to colonel. His Web site contains a photo of him shaking hands with Defense Secretary Robert Gates.
He is at least the third officer to refuse orders because of claims that Mr. Obama is ineligible to serve as commander in chief. Last August, Army Capt. Connie Rhodes filed a complaint in federal court claiming that she shouldn’t need to deploy to Iraq because of claims that Mr. Obama was ineligible. The judge tossed out her case, and Capt. Rhodes, a doctor, eventually left for Iraq.
At around the same time, Army Maj. Stefan Frederick Cook fought orders to deploy to Afghanistan by raising similar questions about the president’s standing. The complaint was thrown out, but the Army revoked its mobilization orders and allowed Maj. Cook, a reservist, to leave active-duty ranks.

Since the Presidency is occupied by an Illegal Alien/ Felon and therefore Unconstitutional, A State of Anarchy at the Federal Level now exists, until the Fed is brought into compliance with the Constitution. It appears the only Legal Authority is the State Government…..Since the Fed is Illegal who is in charge of the Military, Borders and etc.?

There are 4 camps pf people when it comes to eligibility issue
1. Person believes that Obama has all of his archived documents in order and has no problem presenting them to the public to comply with US Constitution.
2. Person suspects that Obama might have nothing in the archives and demands from Obama top open access to these archived files to resolve the doubts one way or another.
3. Person is so sure that Obama is not eligible, that he is ready to fight, to block and to evade any attempt to access archived files.
4. Person thinks that it is an insult or mortal sin to ask Obama to show any proof of his eligibility and constitutional compliance.
Obama is firmly in the third camp. Most of journalists are in the forth.
