Update on Barnett v Dunn, Bowen, Brown et al

Posted on | June 3, 2010 | 1 Comment

Yesterday there were 4 attorneys representing Secretary of state Debra Bowen and Attorney General Jerry Brown. From what I understand the lead attorney for the government is Toni O’Brien.

The only issue on the docket yesterday was the request for the ex-parte hearing.

Judge Shellyanne Chang issued an order re ex-parte based on the pleadings without oral argument. If another court does not issue an injunction or a writ of mandate or expedited hearing, the defendants have 30 days to respond. The case was filed May 10th. It is my understanding that the Secretary of State and the Attorney General were served the same day. The process server had a hard time serving Damon Dunn. He lives in a high rise building with a security guard and concierge. The security guard and concierge wouldnot let the process server to go in and serve him with the law suit. The concierge told her that Damon Dunn did not give an authorization to let her in or to leave the documents with the concierge. She tried to serve him several times. Finally she left a copy with his secretary at his office and brought the documents to Hermosa Beach where he was supposed to speak at an event. When she tried to serve him there, he raised his hands and refused to accept the papers, he dropped them on the floor and his campaign manager picked them up. Another individual has recorded all this on tape. Due to the fact that he was evading service of process, it took a few extra days to serve him, and the count of 30 days started when he was served.

I guess, what people don’t understand is that the state of CA has a 10 days rule. Even if a person wins an election, there are 10 days to contest the results of the election and de-certify the results, so I guess Judge Chang does not feel there is a rush, as there are 5 day left before the election and 10 days after, over 2 weeks in total.

IN regards to what the government will do, you need to contact the Attorney General of CA office, ask for Toni OBrien- Assistant Attorney General OF Ca. You can forward to him the video made by William Wagener “Nomination Fraud”.

Lady Liberty:…I see that Judge Chang held her review in (her chambers???)! Wasn’t she supposed to hold court (in the court room, to make this official)? Is this proper procedure? Did she actually get that case from the docket, that Pamela Barnett filed?
    Am curious about this.

Take care and hope you can advertise (in the largest newspaper[s]?) this coming Friday-Saturday-Sunday-Monday, etc.? And I will continue to send out emails on certain things!
