Update in Indiana, proposed order is sitting with the clerk downstairs for 2 days, they haven’t forwarded it to the clerk upstairs for the judge to sign

Posted on | August 15, 2012 | 7 Comments

Federal Express delivered the proposed order to the Superior Court in Indiana yesterday morning by 10 am.  I specifically paid over $50 for the FedEX. We talked today to the clerk of Judge S.K. Reid. She stated that the judge cannot sign the proposed order yet, as the clerks from the downstairs did not forward the proposed order to the judge. For 2 days the FedEX letter simply sits downstairs. 2 Plaintiffs are planning to go to the court house tomorrow and talk to the clerks downstairs and request to forward the proposed order to the judge expeditiously. Several times pleadings, proposed subpoenas, exhibits that were sent certified mail of FedEX disappeared. I hope it will not happen again.

You seem to think once the judge receives your proposed order she’s just going to sign it right away.

Just FYI, that’s not how it works. You do know opposing counsel gets to review it, right? Right? I didn’t think so.

And not only that, there’s no time limit in which she has to sign the order.

You just file your Amended Complaint timely and the rest will take care of itself.

Shouldn’t heads roll on activities like this delay tactic.

    But where do you go?

How can you take them to COURT, they are the COURT.

Time is very VITAL RIGHT NOW, with the Presidential Election just a little over two months away, and here we find a clerk playing hide and seek with some very important court papers pertaining to one of the Presidential Candidates.

    Have a Nice Day.

Can’t the plaintiffs get the local authorities involved? ie: Local Sheriff?

How about getting the names of all the clerks at that courthouse and literally bring a lawsuit against them – hit them in their pocketbooks
make ’em pony up their hard earned cash – there must be some laws on the books that goes to their negligence of duty.

    Git Er Done !

    God Bless you Dr. Taitz.

Orly: would it help if the (2) who are going there ask:
    1) Why didn’t the lower clerk send it up?
    2) Why wouldn’t the upper clerk call down and ask where the info is at?

It sounds like they are pranking you around! And when the (2) arrive, maybe ask them to get a message to the clerk upstairs (or go upstairs?) themselves? And have them get a note to the Judge Reid, to let her know what happened!!

Shouldn’t some heads roll for allowing to this kind of illegal delaying tactic to possible derail a Court filing?

Similar things like this have happened to Dr. Orly Taitz, Esq. in the past, so it doesn’t just look like an accident.

At the very least the clerk that is responsible for this happen should be reprimanded for letting this happened.

    Have a Nice Day
