Attention Honorable Sonny Purdue
Governor of Georgia,
Honorable Governor Sonny Perdue,
Guardsmen have a unique services commitment from other uniformed servicemen. They serve two masters. They serve the governor of the state under Title 32 USC and also serve the President of the United States under Title 10 USC. At anytime, day or night, 24/7 their Commander-in-Chief may alternate. In some cases that may occur on the same day. This unique employment arrangement also leaves these guardsmen subject to both state criminal jurisdiction and criminal jurisdiction under the Uniform Code of Military Justice (UCMJ). In the prior, any crimes they may commit out of uniform or in uniform if not directly a military offense would be handled by the state judicial system. In cases involving strictly military offense or at the call of their commanding general, subject them to trial by courts-martial. In this case, they would be brought back on active duty involuntarily to face the UCMJ system. This leaves guardsmen in another unique environment.
Should either the governor or the President fail to properly qualify for the respective office their orders as Commander-in-Chief could be determined null and void. Should a guardsmen carry out these illegal orders it places them in criminal jeopardy by either or both the state and the federal governments. The remedy is simple. The US Constitution allows for Quo Warranto investigation of the President. The state constitutions provide for other means. Quo Warranto is am important aspect of our constitution in that it recognizes that certain people, i.e., those who take a special oath of allegiance and obedience to the President have a unique standing above the normal citizenry and there for also have special standing with the US Supreme Court to be herd when grievances against their oath have been committed by person or persons they are sworn to serve. This special standing also relates to the state level.
A governor’s right to assemble a militia rests with the United States Constitution and is provided by statutory authority under Title 32 of the United States Code (USC). Like Title 10 USC, it is a federal mandate. As a result any act of grievance against a member of the state national guard regardless of which statutory authority the member is under orders retains the right of Quo Warranto. Therefore it is likewise the morale, legal and ethical obligation of both the governor and state attorney general to insure this sacred right is both protected as well as to ensure it is executed. Failure to do so puts enormous burden on the guardsmen as well as leaves open the possibility of reduced numbers of volunteers to join the guard simply out of fear of retribution. In light of these facts I request your action.
Please find attached a letter requesting your initiate a Quo Warranto investigation against now President Barack Hussein Obama, Jr. The letter and also attached draft brief with motions will detail the alleged offenses, law and evidence that substantiate that he be immediately removed from his office to not only preserve the Constitution of the United States as well as protect your guardsmen from the repercussions of his illegal orders.
Yours sincerely
