This is the reason why President Trump should wait for a month for Neil Gorsuch to be seated on the Supreme Court before he files the appeal with the Supreme Court.

Mitch McConnell should use 51 vote nuclear option to confirm Judge Gorsuch ASAP, so he can cast a vote in this case.
