If 9th Circuit panel refuses to stay the order by the WA judge, Justice Anthony Kennedy is likely to stay it and allow the ban to go on

Today at 3pm PST the parties will argue the stay of the order by the WA state judge, which temporarily halted the immigration ban. 9th circuit is the most liberal in the country, they typically put open borders and globalism above all else. Two out of 3 judges on the panel are appointees of Dem presidents Obama and Carter. If they refuse to stay the order by the WA judge, it will go to the Supreme Court to review the stay application, which goes to the justice who is in charge of this circuit, in this case it is Justice Kennedy. Though Kennedy is more liberal than other Republican appointees, he is very likely to stay the order by WA judge and allow the ban to go on. The reasons are:
- lack of standing for the states
- vast powers of the president to exclude groups of immigrants under 8 USC 1182f
