    Two ‘birthers’ dump lawyer Taitz in O.C. suit against Obama

    Two plaintiffs in a federal lawsuit challenging President Barack Obama’s birthplace have dumped controversial Mission Viejo lawyer Orly Taitz, saying the attorney is “in over her head.”

    Taitz continues to represent another 40 plaintiffs in the case, filed in Santa Ana federal court, which also challenges Obama’s legitimacy as president.

    Buena Park Pastor Wiley Drake said he’s turned to conservative-issues attorney Gary Kreep because Taitz’s errors that have delayed proceedings.

    “Orly is getting overwhelmed,” Drake said. “We all make mistakes, but she is in over her head.”

    Taitz’s initial complaint was sent back to her by the court, as was a filing last weekend alleging the possession of a Kenyan birth certificate for Obama. Among omissions in the more recent document was such basic information as Taitz’s bar number.

    In another recent filing by Taitz, her own name was misspelled as “Orley.”

    “I rest my case,” Drake said.

    Taitz responded by saying, basically, that Drake and co-plaintiff Markham G. Robinson couldn’t fire her because she was dumping them as plaintiffs.

    “They will have to file their own case,” she said.

    Drake and Kreep said that it was Drake’s lawsuit, and he could not be unilaterally dismissed by an attorney.

    Kreep, who has also represented abortion foes and is counsel for the Minuteman Civil Defense Corps, said he is looking to make changes to Taitz’s filings.

    “There were some problems with the initial complaint,” he said. “It needs to be amended to make the case stronger.”
