Didn’t the state of Virgina just disqualify both Rick Perry and Newton Gingrich from appearing on their ballot for the upcoming primary in a federal election because they had not met the requirements? If Obama’s argument holds true, then only congress can keep a candidate off of a federal election ballot, so the state of Virgina could not disqualify Perry or Gingrich, but only congress. What an outrage, this would nullify the 10th Amendment entirely. You should be able to kill this argument with both hands tied behind your back.

Each party in each state sets the rules as to how to be placed on the ballot. The GOP of VA required 10,000 verifiable signatures. These two failed to meet that requirement. The Constitution sets forth how electors (the Electoral College) are elected. They leave it to the states to determine winner take all or based on the popular vote percentage.

Why do birthers have such a difficult time understanding simple concepts, like the difference between a primary ballot and an election ballot?

Birthers like to pretend to be lawyers. I guess that’s better than pretending to be doctors, but not much better.
