Once again proving the endless depth of your legal knowledge.

Malice is not an element of breach of contract.

Most of what’s written in the response is pro forma. Look it up.

the covenant of good faith and fair dealing is a part of every contract and Adam Silver showed lack of impartiality, acted in bad faith and clearly breached a covenant of good faith and fair dealing

There is no covenant of good faith if the contract itself is clear. The only real issue is whether these NBA contracts are anti-trust, but as Sterling has relied on the contract himself, it’s difficult for him not to make that point, and the courts have previously upheld these types of agreement.

Would you be saying the same if a different owner had said – even in a private conversation – that it was ok for his girlfriend to fuck Jews but not to be seen in public with them? I think not.

the contract is not clear punishments before were $100,000 and not 2.5 million and ban, Adam Silver clearly acted in bad faith and yes, I would state the same. I stated that his comments to his mistress were inappropriate and dumb but did not amount to the level of punishment applied and most legal analysts agree with me
