Liberals have always loved unelected Judges. Why worry about trying to get an unpopular socialist agenda through the legislature, when you can find unelected judges who will issue mandates from the bench. The left has always liked the unelected Federal Judiciary. But in years past, the
left learned some issues will not make it to Federal Court. They would instead be decided in state courts, so the left has pushed for decades to change the judiciary from elected to appointed and therefore unaccountable to the public.
In 2009, seven Supreme Court Judges in Iowa found an undiscovered portion of the Iowa constitution that guaranteed gay marriage. The people of Iowa were unhappy about it but the unelected judges and the left did not worry. Why should they?
In 1962 Iowa changed from electing judges to something that is dishonestly called “merit selection.” Instead of the voters choosing, a panel, controlled by lawyer groups and other liberal special interests decided who would be nominated and sent to the Governor, who would then make the final selection. Those judges would later be subject to a “retention” vote. In a move reminiscent of the old Soviet Union or Saddam Hussein’s Iraq, they would be the only name on the ballot. The voters would have a
choice, either keep or reject. In the forty-eight years the system had been in place, not a single judge was ever
voted out of office. Most won their elections with 70% of the vote.
In 2010, the people of Iowa, angered by this blatant legislating from the bench voted out all three of the Supreme Court judges who made that ruling and were up for retention. Four others who voted for the decision were not up for
reelection. Republican legislators have indicated they are going to try and impeach those four.
In Tennessee, in 1974, the state legislature changed the law and judges for the Court of Appeals and the Court of Criminal Appeals were put under the dishonest “merit system.”
The selection process was set up so that liberal politicians and special interests controlled it. In 1990, the Tennessee Supreme Court was added to the list of merit selection and in
1994, the trial courts were partially included.
Something funny happened in 2010. Republicans took huge majorities in the State House and State Senate.
The system, which is referred to as the Tennessee plan will expire in 2012. Republican state legislators are already talking about abolishing the system and making all
judges in Tennessee, from the small city court judges all the way to Tennessee Supreme Court Justices stand for popular election.
As you might guess, the left is having a heart attack over this. Lawyer groups and Democrats are out there protesting this. The worthless liberal Tennessee newspapers are beating the drum on this. A group of liberal lawyers and politicians, which only a liberal newspaper would describe as a “non-partisan” group is soliciting donations to help fight this.
Republican legislators are called many things, but courageous is generally not one of them. The Republicans who are fighting against leftist tyranny on this one are
going to be subject to a lot of pressure and probably some hit pieces from the media if they do not back off on this.
We can only hope that they will show some intestinal fortitude and destroy this system that allows liberals to keep a lock on one part of the government.
As we now sail into the New Year, many state legislatures are coming back into session. For the thirty some odd states that use this fraudulent “merit system” for selecting judges now would be a good time to drop it. Tea Party groups, as you talk to your state legislators this year, should strongly suggest that all judgeships in your state be subject to
popular election.
This is just one more fight in our struggle to take this country back from socialism and restore liberty.

Orly:…the 3 judges WERE voted out! And they were “flabbergasted!” I loved it! And the candidate who started the “flap” over this, is now trying to turn up the “heat” to have the other 4 judges to “quit”! They (along with the “derelicts” in the legislature and the attorney general) also thought the “same-sex” marriages were fine!
So the “lack of respect” for the “heterosexual” life-style was brought forth by those in power, to subvert the “will of the people.” And when the folks in Iowa get upset, the “applecart is then turned-over!”
I agree with the prevailing “wind” of thought on this! As now, there’s talk of trying to get the state legislature to bring the same-sex marriages up for a vote by the people of Iowa, the next time around. That will “solve the problem!”
Most the people in Iowa couldn’t believe that the state would actually “allow” this “perversion” of the union between a “man and a woman”! They saw what the Supreme Court in Iowa did with their “support for the idea”! So the people “spoke” in the Nov. election…and boy, did they ever!
The other 4 judges were lucky they weren’t up for re-election, as well. They would’ve joined the “exodus,” stage left!!!
This vote by the SC showed how the “will of the people” was being subverted by people with power, who think they can just “do as they please,” and not have to pay for it!
So I agree that the SC judges should be voted on “merit!” To keep them “honest” and to remind them that they are here to “do what’s right,” not what they think they can “interpret” any way they want!
(That sounds like what Kagan and Sotomeyer are going to do!)
I know the attorney general is a (D)! And some of the “sheeple” are just nothing more than “drones”! Can’t get them out of the “fog” that the establishment likes to spread all over the place! Something like “fertilizer!” I know…I tried to discuss (Obama) with some “corn-cobs” before the election, but they couldn’t “grunt in full sentences”!
Some of these “real McCoys” only have time to “slop them hogs,” Gomer! Brrrrrrr!!!!!!
This makes a lot of other Iowans appear too “conservative,” when the majority are very well adjusted to “discern” truth!

2011 Is going to be a busy year. Michigan swore in a new Republican Government yesterday which was a defining moment in a Democrat’s state history. One judge and also some sitting Senate members are next on the list for change.
God Bless & Keep Fighting

I hope you’re not suggesting that all federal judges be elected by the people, because that would cripple the power of the Constitution.
A major function of the Constitution is to place limits on democracy to protect the rights of protected classes, and other minority groups where laws are without rational basis.
It’s one of the checks and balances built in to the system. I realize that federal district courts are created by Congress, but that’s where all the legal action starts.
If federal judges were all elected, they would be bending to the rule of the majority, and this would cripple the power of our Constitution. You should understand this if you were well-read in Constitutional law.
We do have a way to overrule federal courts, albeit indirectly. It’s called amending the Constitution, and it requires more than a simple majority vote in one area. That’s the whole point, Orly.

Josh,
Your bloviation sounds kinda-sorta intelligent, but Thomas Jefferson would whole-heartedly disagree with you:
“In the Judiciary, the judges of the highest courts are dependent on none but themselves. In England, where judges were named and removable at the will of an hereditary executive, from which branch most misrule was feared, and has flowed, it was a great point gained, by fixing them for life, to make them independent of that executive. But in a government founded on the public will, this principle operates in an opposite direction, and against that will. There, too, they were still removable on a concurrence of the executive and legislative branches. But we have made them independent of the nation itself. They are irremovable, but by their own body, for any depravities of conduct, and even by their own body for the imbecilities of dotage.” — Excerpt of a letter from Thomas Jefferson to Samuel Kercheval, 06/12/1816

Porky, your ridiculous and self-serving reading of historical excerpts may lead you to the conclusion that Thomas Jefferson opposed Article III of the Constitution, but anyone with an informed view of history knows that this is not the case. The Constitution says that judges that judges “shall hold their Offices during good Behavior” – i.e., for life. This was the intention of the Founders, and it remains the best possible system. Don’t like it? Why not move to a country like Russia – they elect their judges over there. I’m sure you’d be happier there.

Hi John,
Thanks for providing all that insight to convince me that Thomas Jefferson didn’t mean exactly what he wrote in his own letters. I think it’s clear that your “informed view of history” trumps Jefferson’s own words.
And left is right, up is down, black is white and the sky is green and the grass blue. Welcome to 1984. By any chance, do you work for the Ministry of Truth? If not, you should.
