A Democrat votes against the health care law

The 11th Circuit Court of Appeals ruled today that the individual mandate is unconstitutional, but the rest of the health care law stands:

The 2-1 ruling marks the first time a judge appointed by a Democrat has voted to strike down the mandate. Judge Frank Hull, who was nominated by President Bill Clinton, joined Chief Judge Joel Dubina, who was appointed by George H.W. Bush, to strike down the mandate.

Judge Stanley Marcus, in a dissenting opinion, said the mandate is constitutional. He was also appointed by Clinton.

The panel partially upheld a ruling issued in January by Judge Roger Vinson, who struck down the entire health reform law. However, the 11th Circuit ruled that the rest of the legislation can stand even if the mandate is unconstitutional.

  4. This is just the beginning. There are court cases regarding Obama’s FRAUDULENT Social Security Number and testimony from the guy who purports to have faked Obama’s Birth Certificate!!! Not only that but check this!!! California attorney Orly Taitz today secured an order from United States District Court Magistrate Judge Richard L. Puglisi demanding representatives of the Hawaii Department of Health appear in federal court Sept. 14 to show why Taitz should be prevented from seeing whatever original 1961 documents the agency has on record regarding Barack Obama’s birth. Taitz returned to federal court in Honolulu today after Hawaii DOH officials presented her with a letter refusing to comply with her subpoena on grounds that Hawaii privacy laws prevented officials from releasing Obama birth records to the public.
