There is incorrect reporting on the action of the 9th circuit. They did not decide on the merits of the stay yet.  They did not rule ex-parte and stated that they need the response by the plaintiffs, the states of WA and MN by midnight today and will rule probably tomorrow. However, on the panel there are 2 appointees by Democrat presidents out of 3 judges. One judges was appointed by Obama, one by Carter. So, they are likely to rule for open borders and to uphold the threat of terrorism and will uphold the stay even though constitutionally they should strike the stay by  Judge Robart.

Firstly, the states do not have any standing to even maintain this law suit. In case of TX v US Judge Hanen ruled that the states had a particularized injury in that the states had to spend millions of dollars on drivers licenses of illegals who got the legal status by Obama’s executive orders. In case at hand WA and MN did not show any particularized injury to the states.   If a few citizens of these 7 foreign nation do not visit those states for a limited period of 3 months, it does not represent damage to the states. If these few individuals have working visas or green card, and do not show up for work, American citizens can take those jobs, we have 95 million adult American citizens, who are out of labor force. If a few of these foreign nationals are on student visas, those seats in Universities can be taken by Americans, who did not get in. In most of the universities only a half of all the applicants get accepted. There are thousands of American students that will be happy to take those seats. Let American kids take those seats, their parents worked all their lives, paid taxes to support these universities. Additionally, many green card holders and others got waivers from the ban. The state did not show any particularized damage to the states, the decision is totally barren of any explanation, how the states suffer from the ban. The only damage shown was to a few foreign nationals who do not have any inherent rights to visit the US.

Additionally, under Title8 12f the president  has vast powers to deny entrance to the US of individuals who might represent a threat to the nation. Judge Robart did not address this issue at all. In my view this decision is an embarrassment to the US judiciary.

Judge Janine Pirro annihilated Judge Robart yesterday by calling him egocentrical, community activist and plain wrong on the merits of this ban.

At any rate, I believe that if the most liberal 9th circuit does not overturn the ruing by Judge Robart, then President Trump should wait till the next month, when Judge Gorsuch will be seated on the Supreme court before they appeal to  the Supreme Court.

    Trump needs to be deporting 24/7 many hundreds of thousands. There now will be thousands of mooslims coming next few weeks and there are already 35K here for FY17. It could be as late as mid-April for the added Supreme judge, it needs to be ASAP.

    My question for these Judges is why didn’t you put a halt to Obamas immigration orders? If they say it’s unconstitutional now, why wasn’t it back then? Proof theyre just liberal hack judges.

    No problem with the website from my computer. By the way. Trump needs to simply declare a “national state of emergency” to skirt the legislative and judicial branches. It’s within his constitutional powers to enforce immigration laws. He needs to stop playing by their rule book with one arm tied behind his back and go full on nuclear with these treasonous satan-worshiping liberals.

    This judge needs to be impeached.
    To impeach a federal judge do we need simple majority vote instead of 2/3?

    For impeachment we need a crime or serious violation of the oath of office. Additionally, impeachment is only an indictment done by the lower house. Additionally, there has to be a removal by 2/3 of the Senate. GOP does not have 2/3/ So, a judge might be impeached by the house, but he will not be removed. Of course, impeachment in itself is a blemish on the name of the judge
