Update on Indiana Monday trial, it is still on in spite of last ditch effort by the defense to stop it

I wrote a lengthy report, but it disappeared, so I am writing it again,

Just before court closing in Indiana defense filed a motion to vacate trial. It was not granted, I checked, the trial is still on.

Additionally, John Sampson, who complained that his subpoena was sent to his work address, was served yet again at his home address. He received the service of process through the FedEx.

Sheriff Arpaio and his investigator Mike Zullo were served by both Fedx and by a professional service.

Zullo wrote to one of my supporters. He claimed that he will not testify because it jeopardises his investigation. He also said that they are hoping the Congress will do something and Arpaio yesterday talked to some congressman.

1. We sent all the info to Congress, and so did Arpaio and Zullo. Congress did nothing for 4 years and claimed that this an issue for courts to decide. The whole problem is that Congress and courts are kicking the can and pointing fingers at each other. People from all over the nation donated to Arpaio generously not because they wanted Congress to do something,  not because they care about the crime rate in Maricopa County, AZ, they donated millions of dollars, because Arpaio went public with his findings, did multiple press conferences, where he and Zullo stated that Obama’s papers are forgeries, Arpaio through World Net Daily kept asking people for money for this investigation, promising people that it will be prosecuted. People know that Congress does not want to do anything, they relied on Arpaio, they hoped that Arpaio would file his case before the election and that it would be prosecuted before the election. It did not happen.

2. Police officials, who want their investigations to be confidential, do not do huge press conferences and fund raisers with video presentations on findings in their case, they stay quiet. Arpaio went public and he is asked only to confirm., what he already made public.

3. Arpaio and Zullo submitted sworn affidavits in a similar civil case in Florida. This case was filed by attorney Klayman, who is connected to Joseph Farah, editor of World Net Daily,  on behalf of plaintiff Michael Voeltz. Unfortunately for them, Klayman’s case was dismissed right away, it never went to trial and it was the end of it, however, since they submitted their sworn affidavits, thye no longer have an expectation of privacy, they knew that they can be asked to appear in court to authenticate their affidavits.

4. There was no defamation of them either. I am pretty sure their attorney will explain to them that there are very different standards between free speech and statements in regards to private people and as it relates to public figures, such as Arpaio and Zullo and Sampson, people who are running for public office (Arpaio and /Sampson) or doing large press-conferences on issues of public affairs, such as Zullo. It is proper for public to comment and state, what they think, what they suspect. In the radio show I was asked by the talk show host , why do you think they are not showing up and not testifying? It is acceptable in this situation to respond what I think, what I suspect. If you listen to the interview , you can see that I was very careful in stating: I think, I suspect . Moreover, you can see that for the last week or two there were multiple articles and posts on multiple web sites where multiple members of the public were stating: we think, we suspect that there was some type of a deal, some type of understanding that Obama Justice department dismissed their case against Arpaio and Arpaio will not seriously pursue criminal case against Obama. For several weeks prior to my interview thousands of people wrote all over the Internet: we are suspicious, why after so many press conferences and fund raisers Zullo and Arpaio suddenly got quiet, why there is no criminal case, why Obama is still on the ballot in AZ, why Zullo stated that they did not file a criminal complaint with the FBI, why they are refusing to appear in court and confirm what they already announced in public?

5. It is not uncommon for members of law enforcement to appear in court and testify in civil proceedings in relation to what they made public

6. after 4 years this is the only trial scheduled and we might not have another opportunity

7.If they do not appear in court, they might expose themselves to a serious legal action on part of their donors for taking donations under false pretenses. There are very serious repercussions to their actions in that Sampson admitted on the radio show that three of them agreed not to appear in court, even though they were served with court subpoenas. There can be repercussions from the court and from the plaintiffs in the case.

As such, it is to their benefit to appear in court and simply confirm to the judge what they said in their subpoenas. If this case is lost because they refused to appear, the nation will not forgive them.

    Doesn’t Sampson’s radio show admission make it witness tampering by Arpaio, and in addition, RICO by all three?

    The part I like is when you flip Arpaio and he turns state’s evidence against Eric Holder for using the Justice Department to suppress evidence incriminating Obama. That’s probably witness tampering by Holder.

    And as long as we’re flipping folks… who is above Holder in this for him to rat on? Wait… gimme a minute. It’ll come to me…

    Oh, okay… got it.

    This thing with Sampson is still very strange. He helps you, Dr Orly, in other cases, and he doesn’t say a thing. Then, all of a sudden, he has changed his mind and not help. Why would he do this? And why would he allow Arpaio and Zullo influence him, not to do what he knows is right? If he wasn’t trying to be complicit in his actions, wouldn’t he privately let you know what the real problem was?
