Orly, if you are contractually obliged to do the Colbert Show, then I suggest that you bring a friend along to video you the whole time that you are in the studio. You will then have evidence to put on you-tube to counteract any deceptive editing that the Colbert Show use in their broadcast. Another safeguard is to decide in advance what message you want to put over and then strictly confine your answers to these main points – regardless of the questions that Colbert asks you. For example;
“I know you want to ridicule my message but I’ve come along here anyway to try to inform as many Americans as possible that, due to the REQUIREMENTS of The Constitution, Barack Obama is not eligible to be President of The United States”.
“Barack Obama’s Father was a British and Kenyan citizen, but NEVER an American citizen, so Barack Obama II was, at best, a dual-national at birth and that does not satisfy the Constitutional ‘Natural Born Citizen’ Requirement for the Presidency. In order to be a lawful President, BOTH parents must be American”.
“Furthermore, Barack Obama is covering up important information about his past, such as the details contained in his full long-form birth certificate, his passports and his college records. Anyone with an ounce of common sense can see that Obama is desperately hiding much of his past from the American people – this makes him a security risk”.
It is important to stay ‘on message’ and not to be goaded into saying anything unscripted that can be twisted and used against the cause. Make no mistake Orly, you have got them worried and that is why they are so desperate to try to discredit you and your message.

I agree with Joe the Blogger, it covers all the main points perfectly, and if the audience has an once of common sense it will pique their curiosity. One example: Why is this the first time I’m hearing about this? (in their minds). I think people are very unaware of the media black-out and out and out lie-out.

I believe the argument I present below could be a new opening to force discovery.
The Obama team statement is wrong that Obama could get no more records than he already has produced under Hawaiian law. In fact, Hawaii Revised Statute HRS 338-13 states that any qualified person can get a copy of any vital statistics record held by the Hawaii Department of Health pertaining to that person. The statute is written very broadly. That means that if Obama was born in Hawaii, he would have a right under this statute to any record held by that department. That would include any long-form birth certificate they may have.

CNN president Jon Klein stated that the Hawaiian Department of Health had destroyed all “paper” birth certificates back in 2001.

In fact, under Hawaiian law, the Department of Health is “authorized to prepare typewritten, photostatic, or microphotographic copies of any records and files in its office, which by reason of age, usage, or otherwise are in such condition that they can no longer be conveniently consulted or used without danger of serious injury or destruction thereof, and to certify to the correctness of such copies. . . . ”

Thus, even if the department destroyed the original paper copies, they still may have electronic copies. In fact it is likely that they do, because the purpose of that department is to store records. Of course, any copy of any record they have on a person can be requested by that person, or other qualified applicant as above.
The Department of Health publicly disclosed the existence of Obama’s original birth certificate in their possession. This was in the form of a statment made to the media.

Nevertheless, under Hawaiian law it is illegal for the Department of Health to disclose the existence of anyone’s birh certificate to anyone other than statutorily-authorized persons. Journalists and the general public do not qualify.

Thus, it would have been illegal for the Department of Health to release any information as to Obama’s birth certificate, except on one condition.
The statute does not prohibit them from stating that they have a birth certificate if they do not actually have the birth certificate. They could lie.
It is a legal presumption in probably every state, and probably in federal case law, that government officals are presumed to have acted according to the law. This is sometimes listed in a statute. This is a legal presumption.
With the legal presumption that the government official who declared that the Hawaii Department of Health had Obama’s original birth certificate, and the impossibility of him doing so because (A) the original paper documents were destroyed according to CNN, and (B) it would have been against Hawaiian law for him to disclose that record, it becomes a genuine issue of material fact as to the status of the birth certificate of Obama. Therefore, discovery should be granted.
That statute does authorize access to a record for “A person whose right to inspect or obtain a certified copy of the record is established by an order of a court of competent jurisdiction;”

Of course, that would mean any “qualified person” could get any copy that the Hawaiian Department of Health has in pursuit of the court order.
Why did CNN conduct their investigation and only now release what they found?
I believe that one of the strongest arguments you have is that Obama has spent over a million dollars trying to prevent the release of a $10 long-form birth certificate. You should use this argumentin public and in the courts.

I have recently been been reading online about this whole ineligiblity of Mr. Obama… initially I dismissed it.. but now I am beginning to think there is something to it. Thank you so much for all the hard work you do.. I’m not able to afford donate money right now.. but please know.. as an american.. I from the bottom of my heart thank you!
–BTW.. on colbert’s show.. quick lines/ points you can make:
1) the hospital said in 2008 they have seen the BC and its legit, and yet now they say “the birth certificates” were destroyed in 2001….. well then how can they say in 2008 they have seen something they are now saying was destroyed in 2001? how can they confirm a birth certificate that they themselves claim was destroyed?
2) Obama has hired lawyers. spent 1 million dollars to hide his college records, birth certificate.. WHY? heck.. it must cost only $20 bucks to show it.. joke with Colbert that you will even pay for it.
3) Distinguish between a COLB (certificate of Live Birth) which only shows that you were born alive… and a Birth Certificate.. which should be embossed with a seal and it shows WHERE you were actually born etc.
you will do absolutely great… always make sure if Colbert leads the questions.. answer: “why won’t he release his Birth certificate?.. Mccain did it within weeks of someone inquiring”….”are americans not allowed to see if the CIC is ACTUALLY BORN IN AMERICA?”

Where is this Constitutional ‘Natural Born Citizen’ Requirement for the Presidency? Yeah, the one that says in order to be a lawful President, BOTH parents must be American?
All that I find in the Constitution is this:
“No person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President; neither shall any Person be eligible to that Office who shall not have attained to the Age of thirty-five Years, and been fourteen Years a Resident within the United States.”
Waiting to be enlightened.

Obama’s Family Forgery shines USA!
Reason of fact proports self evidence to the frame’d light of the COLB of OBAMA shown to be a fake. Along with a fake COLB, we are now seeing that this is not the only documents or photos forged in the Obama tall tale. As tall tales go, should the Documents be fake why not check the family photo’s also… and sure enough. More evidence is coming out that more history has been fabricated about OBAMA’s Family Forgery beckoning the question… where did this man come from?
Included with this Press Release is an attached file that contains Obama’s Family Photo’s that relate that not just Obama’s COLB was a forgery but also many Family Photo’s released to the media.
Dr. Orly Taitz’ amended complaint with the U.S. Supreme Court. The photos mysteriously appeared on the huffington.com web site, and the time reference within each photo demonstrates both the times and dates of each photo’s release. Dr. Taitz referenced her filing time as “2:30 p.m.” These photos have an imbedded time stamp of “5:14:04 p.m.” on the day that Dr. Taitz filed her amended complaint. More obfuscation, or just plain damage control???

The document posted on Barack Obama’s “Campaign 2008” web site was deemed a fraud and “a horrible forgery” by forensic researchers. Despite its lack of proper signatures, seals, numbers, and other important features, the “Certificate of Live Birth” in question reveals a grave, glaring error. Surprisingly, no one has yet to address this issue until now.
The racial nomenclature of the 1960s did not refer to one’s race by denoting skin color. Whites were called “Caucasians,” blacks were called “Negroes,” orientals were called “Asians,” and latinos were called “Hispanics.” Blacks born in American were never referred to as “African” by race, yet in the space denoting Barack Obama, Sr.’s race (on Obama, Jr.’s “Certificate of Live Birth”), it clearly reads “Race: African.” This single anachronism is akin to a “wristwatch in a Shakespeare play.” It is fraudulent and intended to imply that Barack Hussein Obama, Jr. is an “African-American.” The voting public has bought this lie. And so have the Justices of the U.S. Supreme Court. This single fact is proof that Obama’s CofLB is a modern-day forgery — a felony.
With the dawns early light, more and more media reporters are finding their representative instincts of journalism are being traded in for talent in acting and thespian parts and America’s People are waking up and circumventing the misguided TRUST that is being represented by partisan reporting. However the sense of journalistic integrity is alive and well and falling out of the grace of Obama is now being weighed seriously with falling out of grace with The People!

While browsing through the evening news I came across this:
Now, why after a year has a so called picture of Obama as an infant been published in public and why in the UK? Why not the US?
Just publishing and saying so is not proof this is a photo of Obama, since his step-brother,Mark Ndesandjo, is a close likeness to Obama. right down to the lighter shade of his skin.
Mark Ndesandjo is the son of Barack Obama’s late father and his third wife, an American woman named Ruth Nidesand who runs the up-market Maduri kindergarten in Nairobi.
Also, Mark Ndesandjo has done several in-depth interviews the the media in the UK and China, but why none with US media?
This also comes on the brink of in-depth discussions with China over America’s unsettling debt that is owed to them. Especially in the light of the London Times article in which this step brother was urging that there needed to be more import of Chinese goods by Americans.
I am not buying into this photo, the timing of it’s arrival in public is too suspect and the smell of a rotten rat is getting pretty strong.
PS: Orly Taitz, Esq., the lawyer for the military officers questioning Obama’s legitimacy to hold office, has just finished doing several interviews with overseas news outlets. Just thought you might like to know that.

Yes, Joe, very well said. But let’s not forget, Colbert wants his laughs, and Orly should be prepared for his many interruptions which are designed to ridicule Orly and get his studio to respond with laughs. I am quite sure when he tapes, he has either a bunch of college kids, or his own “implants” LOL.
Joe has given good advice. I will only add this: please stay with your plan as Joe said. Each interruption from Colbert, Orly follow up with a very brief review so people do not get side tracked. He is a sharp dude and quick on the trigger, but you have the advantage of significantly more knowledge on this subject.

Kitty, the Constitutional section you quoted is the only law on the subject. There is no requirement that one must have one or two American parents to become eligible for the presidency.
We know that Obama is over age 35 and has lived in the US for enough consecutive years.
The question is whether he was born in the US. If he was, he is a natural born citizen, unless he renounced his US citizenship as an adult (over age 18) which seems extremely far-fetched.
If Obama was born in another country — Kenya or Canada, he would not be eligible for the presidency. That is the issue here.
Arnold Schwarzenegger has often said he would like to run for President. Even as a naturalized US citizen, however, he cannot, because he was born in Austria, and so is ineligible for the presidency.

Kitty and Realist and other unenlightened people –
‘Natural Born Citizen’ is a specific term included in The Constitution, as one of the requirements for a person to serve as POTUS. The purpose of the ‘Natural Born Citizen’ requirement was to try to ensure that no one could serve as President, who might have an allegiance to any country other than the USA. It was well known in 1787, as it had been known for thousands of years that children normally follow the allegiances of their parents (particularly, prior to modern times, the allegiance(s) of the Father).
There is no mystery about this. The framers of The Constitution were just being prudent. They had just emerged from a very costly, lengthy and bloody war of independence and they wanted to try to ensure that the American people would never again have to endure this.
Those of us who conclude that ‘Natural Born Citizen’ means ‘born in the country of parents who are citizens’ (as defined in Vattel’s ‘Law of Nations’) are very keen to have the matter cofirmed in The Supreme Court. Mr Obama and his team of highly paid lawyers and all of his devoted followers are DESPERATE – ABSOLUTELY DESPERATE – to try to prevent this matter ever being decided on its merits in The Supreme Court. We all know why.

Dear Dr. Orly-When you arrive in Chicago if you land at O’Hare instead of Midway. If you have a minute and need inspiration stop by the plaque dedicated to Lt. Commander Butch O’Hare, a great American hero. This is where I grew up,every time I went to O’Hare airport I made it a point to stop and read this plaque to remind myself of great sacrifices made.
Plaque is/was in the main concourse but O’Hare is a gigantic airport, wear comfortable shoes.
