MOTION FOR RECONSIDERATION IN LIGHT OF CHANGE OF JURISDICTION OF THE COMPLAINT FOR CRIMES AGAINST HUMANITY AGAINST KHALED MESHAAL, LEADER OF HAMAS PALESTINIAN ORGANIZATION.
Dear Ms. Bensouda,
On August 14, 2014 the office of the prosecutor of the International Criminal Court in Hague docketed as case OTP-CR-252/14 my complaint against Khaled Meshaal, leader of Hamas, Palestinian Terrorist organization, for Crimes against Humanity.
The complaint at hand related to War Crimes and Crimes against Humanity committed between May and August of 2014 , namely launch of around 3,500 rockets from Gaza, Palestinian territory, into the state of Israel, into densely populated areas. While many of the rockets were successfully intercepted by the Iron Dome defense system, some of the rockets hit targets and caused death and destruction. Due to these unrelenting rocket attacks, most of the population of Israel stayed in shelters. Many young children, women and elderly, subjected to these attacks, suffered severe emotional trauma, which lasts till today.
Due to these unrelenting acts of war by Palestinians, Israel was forced to respond and involve its military in responsive action, which resulted in further loss of life.
Moreover, Meshaal’s terrorist organization Hamas used Palestinian civilians and particularly Palestinian children as human shields in order to protect Palestinian rocket launchers and protect tunnels, which were dug for the purposes of terrorist acts. Use of civilians as human shields represents yet another count of crimes against humanity and war crimes.
At the time the complaint was filed, The Office of the Prosecutor of the ICC responded that it could not proceed, as Palestinian territories were not a member of the ICC yet and as such there was no jurisdiction under the Rome statute.
Today, on April 1, 2015, Palestinian territories became a member of the International Criminal Court (ICC). Palestinian territory is governed by the Unity government, whereby the area of Judea and Samaria, also known as the West Bank (Area of the West Bank of the Jordan River) is governed by the Palestinian Authority led by Mahmood Abbas and the area of Gaza strip is governed by the Terrorist Palestinian Organzation, Hamas, which is led by Khaled Meshaal. Due to the fact that as of April 1, 2015, the Palestinian territory is a member of the Internationa Criminal Court, Khaled Mashaal is now under the jurisdiction of the ICC. Based on the above new facts, Plaintiff Taitz is seeking reconsideration of her complaint OTP-CR-252/14 and criminal prosecution of Khaled Meshaal for crimes against Humanity.
