Boasberg claims that the government has no legitimate reason in keeping  illegal aliens claiming asylum in custody. He bases his decision on the 5th Amendment of the Constitution, however constitutional rights apply to the US citizens, people in ICE custody are not US citizens, they are illegal aliens. Further, these illegal aliens did not even show any legitimate basis for asylum. Some 60,000 unaccompanied minors and 66,000 family units crossed the US border last summer during the surge. Since there are on average 3 people per family, there must be roughly some 180,000 people in the family units and 60,000 unaccompanied minors (typically teenagers 15-18),  there will be nearly a quarter of a million people, who are being released from the  immigration custody based on Boasberg’s order.

Asylum granted to ones who suffer persecution due to political and religious reasons, such as Christians in Muslim countries or political dissidents in communist countries.      People crossing the Mexican border and coming from the Central America, do not fall under any group or category justifying asylum.   Their reason is purely economic. If we were to allow into US everyone who crosses the border for economic reasons, we would have 7 billion people flooding this nation and coming from all over the world.

Further, Boasberg is saying that there is no reason to keep in custody people, who are not a flight risk. Who is Boasberg kidding? All of them are a flight risk. Over 90% of people, who are given papers to appear for a deportation hearing, never show up. One has to be completely retarded to believe that people who risked their lives and crossed Rio Grande and desert areas in order to sneak into the US illegally, would voluntarily show up for a deportation hearing just to be sent back to the country of origin.

I believe that this order releasing potentially a quarter of a million people from custody, is a retaliation, an orchestrated response by an Obama appointee judge to the order by Judge Hanen, who previously stopped Obama’s amnesty.

I am not sure yet how to stop this. Boasberg’s actions are clearly affront to the US Constitution, rule of law, National security and interests of the US workers. Not only he just deprived a quarter of a million US workers of their jobs, as some quarter of a million of illegals will be released, he also crated a huge incentive to millions to cross the border, as they know, there will be no repercussion to their actions.

One thing you can do, is call your congressman, demand a congressional investigations into Boasberg’s actions. Congress can impeach a judge and can remove him from the bench. Though, frankly, I doubt one opinion may be grounds for impeachment of a judge, this decision might be sufficient for removal of Boasberg from the Foreign intelligence Surveillance court, as his decision endangers national security.

Clearly, there has to be an appeal of this order by the government, by the DHS. IF DHS does not appeal, there is a legal maneuver where someone can step into the shoes of the DHS and sue. It is called ex relator standing, though it is very rarely granted.  Lastly, TX and other border states can file a petition with Hanen seeking an order blocking release of these illegal aliens due to negative effect on the states. As such, there will be an order by Judge Hanen affectively blocking an order by Judge Boasberg.

Boasberg is sitting in DC and does not see the negative effects of the illegal immigration. Hanen is sitting in the border town of Brownsville and he has a much better perspective as to what is really happening on the ground.

Please, burn the phone lines to your congressmen, demand a hearing ASAP. Additionally, please, keep pressure on Mitch McConnell. It is time for him to schedule a vote to change the Senate voting ruling and pass the DHS funding bill with 51 votes.

James Emanuel “Jeb” Boasberg (born February 20, 1963)[1] is a District Judge on the United States District Court for the District of Columbia, also serving as a Judge on the Foreign Intelligence Surveillance Court; and former associate judge on the Superior Court of the District of Columbia.

Boasberg was born in San Francisco, California in 1963,[2] to Sarah Margaret (Szold) and Emanuel Boasberg III.[3][4] The family moved toWashington, D.C. when Boasberg’s father accepted a position in Sargent Shriver‘s Office of Economic Opportunity, a Great Society agency responsible for implementing and administering many of Lyndon B. Johnson‘s War on Poverty programs.[5][6]

Boasberg received an A.B. from Yale University in 1985, where he was a member of Skull and Bones,[7] and a Master of Studies the following year from Oxford University.[8] He then earned his law degree from Yale Law School in 1990.[8] After completing law school, Boasberg served as a law clerk for Judge Dorothy W. Nelson of the United States Court of Appeals for the Ninth Circuit.[8]

During the 111th Congress, Delegate Eleanor Holmes Norton recommended Boasberg to fill a judicial vacancy on the United States District Court for the District of Columbia.[9] On June 17, 2010, President Barack Obama formally nominated Boasberg to the District Court for the District of Columbia.[8] Boasberg was confirmed on March 14, 2011 by a vote of 96 ayes to 0 nays.[10] He received his commission on March 17, 2011.[11]

On April 26, 2012, Judge Boasberg issued a publicly controversial ruling. He denied the public’s right to view government photos of a deceased Osama Bin Laden. Judicial Watch, a conservative legal group, had filed a request under the Freedom of Information Act, but were unsuccessful in convincing the Judge that FOIA rights outweighed national-security factors.[12]

On January 18, 2013, Judge Boasberg issued a permanent injunction prohibiting the Internal Revenue Service from enforcing regulations on Registered Tax Return Preparers, which otherwise required tax return preparers to register with the IRS and pass a written test as evidence of competency. Loving v. Internal Revenue Service, No. 12-385 (U.S.D.C. D.C. 1/18/2013). The IRS plans to appeal.[13]

On February 7, 2014 Chief Justice John G. Roberts announced that he would appoint Boasberg to the United States Foreign Intelligence Surveillance Court for a term starting May 18, 2014 to a seat being vacated by Reggie Walton.[14] [15] His term began May 18, 2014

Boasberg married Elizabeth Leslie Manson in 1991.[3] His brother, Tom Boasberg, succeeded Michael Bennet as Superintendent of Denver Public Schools after Colorado Governor Bill Ritter appointed Bennet to the United States Senate in January 2009.[16][17]

    All that is going on within this current regime and the extent to which every single agency, office, and individual, involved, from our congress, senate, courts, and even the agencies specifically tasked with the security of this nation, not forgetting to mention with the total support of the media, makes clear we are nearing the fulfillment of a long term strategy conceived in evil, accomplished through infiltration, bribery, and blackmail, of an already venal omnipotent minded elitist.

    The dye is cast. There can be only one conclusion, or one solution. And it is not going to be relying on an honest congress, an honest senate, an honest court, an honest media, or counting on the the next election to elect an honest “Natural Born” citizen president.

    I think that this judge needs to experience the disease carriers (up close!!!) and come down with a crippling disease, in order for him to see the error of his ways!

    His ruling was treasonous!!!
