SS 331 – Hawaii Health Dept violated HI law – Privacy concerning documents etc., (found under item 9 of SS-331 (sp?) states (paraphrasing) the following :
“Release of documents shall be permitted when
directed as such UNDER COURT ORDER.”
Please forgive my unlearned legal mind. Hawaii law directs the health dept to furnish documents when so ordered by the courts.
I see no reason for the courts to have a “show cause” hearing etc. Perhaps they should have a “Show Documents” session instead of delaying this further.

I believe you’re referring to Hawaii Revised Statute (HRS)
Ҥ338-18 Disclosure of records: (b) The department shall not permit inspection of public health statistics records, or issue a certified copy of any such record or part thereof, unless it is satisfied that the applicant has a direct and tangible interest in the record. The following persons shall be considered to have a direct and tangible interest in a public health statistics record:
(9) A person whose right to inspect or obtain a certified copy of the record is established by an order of a court of competent jurisdiction;”
I totally agree there should be no reason for a show cause hearing but, rather, a show subpoaned documents hearing.
