Trump’s attorneys need to file a motion to recuse the judge. If he refuses, it is one of the bases for appeal

Every judge was appointed by a Republican or a Democratic president so there is no such thing as a “neutral” judge. The only issue is demonstrable bias and Merchan has been totally impartial so far. And at trial the only issue is evidence. So a motion to recuse is highly unlikely to succeed. The better strategy is to prove that the evidence does not constitute a crime. But Trump is on thin ice as far as the facts are concerned.
