Obama’s maneuvers are not going to work

Obama is trying to outmaneuver Judge Hanen. It was announced that Obama regime is planning to file a motion for a stay of his order, which stopped Obama’s lawless amnesty. The Ffth circuit is expected to deny Obama’s petition for stay.

Next move in this game of chess will be Obama’s petition for stay to be sent to the Supreme Court. This petition goes to one justice, who is responsible for this circuit. One of the most conservative justices, Antonin Scalia is supervising the fifth circuit and he, of course, will deny. However, petitioner can file with yet another justice and Obama will file with one of  4 of the leftist judges: Ruth Bader-Ginsburg, Steven Breyer, Elena Kagan or Sonya Sotomayor. One of those might grant a stay of Hanen’s decision. A stay of  Hanen’s decision will mean green light for amnesty. However, this stay will b short lived.

Next move. If one of leftist judges will be corrupt enough to grant a stay, Greg Abbott, the governor of TX, will file immediately a motion for stay of the amnesty, which will be immediately granted by Hanen. Obama will appeal, his appeal will be denied by the 5th circuit and further will be denied by the Supreme court. Game over.

    I wonder how you could possibly consider this an emergency? Also I notice that all the “news” articles, and all the talk shows refer to this as Obamas executive order. I thought it was a memorandum from Jeh Johnson, an unelected official.

    I’d love to hear what rule of law can you cite where a federal district judge can overrule SCOTUS.

    it is a different stay. Obama will seek a stay of Hanen’s order, Abbott will seek a stay of amnesty

    you can’t claim emergency of giving status to people, who were never entitled to this status in the first place

    I guess I don’t “get it” completely.

    If SCOTUS stays Judge Hanen’s Order pending appeal, and there will be an appeal filed either simultaneously with the Application for Stay, how, exactly, does Abbott then legally appeal amnesty before Judge Hanen.

    I could be wrong but I’ve always been under the impression that once an appeal is filed the lower court immediately loses jurisdiction until after the appeal is heard and there’s a ruling.

    I’m serious. I’m just trying to understand how your strategy works legally. If I’m wrong, I’m wrong but I’d like to know in what way.

    Abbott will file a separate application for STAY with Hanen, it will be granted and upheld by the 5th cicuit

    Okay. Thanks. Just one further small clarification…

    So assuming SCOTUS grants Obama’s application for stay, then files a notice of appeal, Abbott will then file a stay of amnesty with Hanen. I think I got that.

    And he can do that even if the DOJ files a notice of appeal with the 5th Circuit. Right?
