A note to Obama zombies: a witness cannot remove a case to Federal court. Obama was subpoenaed as a witness, he is not a defendant. He was subpoenaed just to give him notice and an opportunity to testify as a witness. The trial will proceed with or without him. additionally, at isue is not his work as a federal employee, but his candidacy, as a private person running for office

Word is many forums is that one of the attorneys that received that subpoena from you for President Obama to appear in court is going to have the case removed to Federal court first thing Monday the 22nd since President Obama is considered a Federal employee.

What are you going to do when the case is removed to Federal Court?

    Is the subpoena valid?

Is Obama a federal employee? Or a federal employer? Regardless, an emergency motion in federal court to restrain Obama from filing for removal sounds the way to go. That way, there has to be an emergency hearing before the Indiana trial can be derailed.

    Yes. Enforceable? No.

    “Is the subpoena valid?”

Why would it not be? And, even if it were not valid, how could that stop the trial?

Your identification of yourself as “Constitutional crisis” brings to mind the fact that Barack Obama or whoever he is created this constitutional crisis himself by running for a public office for which criminal investigation indicates that he is not eligible, and chooses to perpetuate that crisis by persistently and defiantly refusing to prove his claimed eligibility as required by our state election laws.

You’re certainly correct that non-Party Barack Obama cannot remove the Indiana case to a federal court.

However, there’s no way you can adjudicate the validity of his birth certificate or other documents WITHOUT naming him as a party.

I’m frankly wondering exactly what this trial on the 22nd is about, since the judge limited it SOLELY to the actions against the Secretary of State and the Elections Commission.

we asked to bifurcate and have an expedited trial only on two issues against 2 defendants. Also, look at Fulani v Hogsett. The court did not find that the candidates, who were sought to be removed be part of the case.
