Update on article2legal defense fund

Posted on | February 27, 2012 | No Comments

I still did not get straight answers on multiple questions asked, but I got some information:

1. Helen Tansey, president of the article2superpac still did not disclose, what type of entity is the offshut from superpac, which they call “article2 legal defense fund”. Is it a not for profit foundation or is it a for profit foundation? Is it a private company? When Helen Tansey is collecting thousands of dollars from the public, claiming that it goes to attorneys, she owes the public an answer

2. What are the names of the people, who run this article2 legal  defense fund? Is there a separate trust account for the fund? Who controls this trust account?

3. Who writes checks from the Article2legaldefense fund?

4. George Miller wrote a correction, that Helen Tansey offered a refund only to donors who are asking for a refund for the money, that they donated to file 2 legal actions by Larry Klayman by February 17, 2012, as those actions were not filed. The correction from George  Miller was that Helen Tansey offered a refund only to people, who specifically are asking for it, she will not authomatically refund everyone. You need to specifically write to her and ask for a refund. From this I understood, that Helen Tansey is the one, who is collecting money and writing checks on behalf of the Article2SuperPAC legal defense general fund.

I am concerned, that a lifelong Democrat Helen Tansey is the gate keeper, she collects the money for legal actions and writes checks. I do not know, whether Richard Garruth and Gary Wilmott are signatories on those checks as well. I do not know, whether other people are writing checks from that fund. While there is some measure of accountability in regards to the SuperPac part of Tansey’s operation, there does not seem to be any accountability in regards to the legal defense fund part of the operation, though most of the donations by my understanding go to this fund. Helen  Tansey is the gate keeper, who is decising, which law suits will be promoted and funded. Until now, she was promoting and partially supporting only legal actions, which were very limited, they concentrated only on Obama’s father’s citizenship, nothing else.

5. As of yet there was no disclosure from either Helen Tansey or GeorgeMiller (Miller is listed as a strategic partner) as to how much money was collected by the article2 legal defense fund and which attorneys were paid. A number of individuals wrote to me and complained that they contacted Helen Tansey and others affiliated with her, asking to cover their legal fees, but did not get one cent so far. I got multiple e-mails from Tracy Fair, who stated, that she contacted Helen Tansey and a few other individuals, she actually filed a law suit, but as of the date of her e-mail (a couple of days ago, she did not get anything, even though her case is much stronger and includes all the evidence of the Social Security fraud and birth certificate forgery.  I asked Tracy what was the filing fee, so I can help her.

6. Aside from the general fund there were specific funds set. I did not get any information yet, as to who owns those specific funds, but I got some information. From what I undertand, when they advertise and ask people to donate money for the law suit in GA, the money goes to one person, Carl Swensson, a plaintiff for one attorney Mark Hatfield. Even though there were multiple plaintiffs and 3 attorneys, the donations went to one attorney, Mark Hatfield. From what I understood, Swensson paid Hatfield and got some reimbursement. Hatfield’s case is limited to Obama’s father’s citizenship, nothing else. So, the public is simply entitled to know, that when this article 2 legal defense fund is advertising, that the donations are going to the legal actions in GA, in reality, from what I’ve seen, the donations are going to one person, Carl Swensson, who is represented by one attorney, Mark Hatfield.

In PA the money went to Charles Kerchner. Mr. Kerchner does not have a law suit yet. He only filed a complaint with the election commission. From what I understand his complaint is limited to  Obama’s father’s citizenship. He will have an attorney with him in front of the commission. I do not want to say anything negative about Mr. Kerchner or his attorney, my point is, that they simply do not have any law suits filed as of now. Most hearings before the commission are free, there is no filing fee, in PA I believe, there is a $35 fee.

In FL so far there was only one case filed by one pro se plaintiff.

In CA so far there was one case filed by a group of pro se plaintiffs.

George Miller wrote, that in the future there will be a licensed CA attorney, aho is working with attorney Klayman and they will take over the pro se case in Ca and Klayman will take over the pro se case in FL. I cannot comment on what may or may not happen in future. I can comment only on what has happened so far. Helen Tansey and George Miller owe the public a straight answer, who controls the FL and CA article2legal defense funds. Who gets all of the donations, which are given and what did they do with this money so far.

Since none of the people, who run the superpac: Tansey, Garruth, Wilmott and their strategic partner George Miller are licensed attorneys, there is a need for them to disclose, where the donations for attorneys went.

7. I never wrote about any expired PA license for Larry Klayman, I did not even know, that he was licensed there a number of years ago. I only wrote about a law suit filed against him by the FL bar, as well as the fact, that he was listed in the Article2 superpac advertisement as a counsel in CA and I noted, that he is not licensed in Ca, all of which is true.

Bottom line, to end this matter, I wrote true and correct statements of fact. Some clarifications were received and posted. We are still waiting for disclosures of financial transactions. When a group of individuals are doing business under a fictitious name and collecting large amounts from the public, supposedly to pay others, to pay attorneys, they owe the public accounting and disclosures: names of the people, who are collecting money, types of financial entities, that they are running, amounts of dispersements, which were sent to lawyers. Lastly, in the state of CA the bar does not allow non-lawyers to be partners with lawyers in their legal work, so when non-lawyers are running such large fundraising for legal work, full disclosure is mandatory, so the bar can see, that attorneys are not partners with non-attorneys.
