Kinder urges Obama administration to respond to lawsuit

(JOPLIN, Mo.) Lt. Governor Peter Kinder responded Thursday to the Obama administration’s lack of response to his lawsuit against the Affordable Care Act.
In a “motion to compel,” attorneys for Kinder expressed their frustration with the Obama administration for not responding to Kinder’s. “More than four months have passed since this case commenced, almost four months have passed since the Defendants were served the original complaint, and now, more than two months have passed since Defendants were served with the amended complaint,” wrote Thor Hearne, an attorney for Kinder.
“Plaintiffs respectfully request this Court order the Defendants to comply with the Federal Rules of Civil Procedure and file their answer or other responsive pleading within no more than fourteen days from today, on or before November 24,” he wrote.
Kinder’s suit was initially filed in July, claiming the health insurance reform law is “unconstitutional.” Kinder amended his claim in August after Missouri voters passed Proposition C, which exempts Missourians from the individual mandate provision under the law. The original suit named Secretary of Treasuary Timothy Geithner, Attorney General Eric Holder, and Secretary of Health and Human Services Kathleen Sebelius as defendants in their official capacities.
“This lawsuit has given voice to the concerns of many Missourians who oppose Washington’s control of our health care system. To this date, the Obama administration has remained silent,” said Kinder in a statement. “The government’s failure to respond in a timely fashion is a further expression of contempt and arrogance against the people of our state who overwhelmingly oppose this law.”
Kinder is joined by a group of Missourians in his suit, but says much of the funding is coming from donors. In August, he released a list of $6,000 dollars worth of donors, but has yet to release anything regarding the rest of the funds.
To a group of Republicans in Rolla, Mo., in September, Kinder said, “We have been assured by some very generous donors that I am going to have all the resources I need, and it’s way up in the six figures, to take that case all the way to the United State Supreme Court where I believe we will prevail.”
When asked by PoliticMo about a list of the additional donors, a spokesman for Kinder said, “I believe he intends to do that soon.”
