Appellants in case 10-55084 are respectfully requesting additional time during the oral argument
MEMORANDUM OF POINTS AND AUTHORITIES
Motion is brought on behalf of appellant in appeal 10-55084. This court sua sponte consolidated this appeal with an appeal in case 09-56827. Oral argument was scheduled at Pasadena division on May 2nd. A total of 15 minutes was given to each side. Attorneys on both cases had a meet and confer on the issue of division of time during the oral argument. Attorneys were not able to reach the consensus on the time. Attorneys for case 09-56827 are seeking equal division of time, seven and a half minutes for each case, attorneys for 10-55084 are seeking more time for argument, due to the fact that they have 40 plaintiffs and case 09-56827 has only 2 plaintiffs. Court of Appeals allows as much as 20 minutes per side on the oral argument. Plaintiffs are asking for additional time for following reasons:
- 10-55084 is an appeal, where 40 appellants are represented. Case 09-56827 is a case with 2 appellants only and presentation is less complicated.
- Appellants in case 10-55084 are 40 individuals with different standing. Since the case was dismissed on standing, it will take more time to argue different types of standing. Case 09-56827 has only 2 clients with similar standing.
CONCLUSION
Due to the above, appellants in case 10-56827 are respectfully asking to be the first ones to argue at the oral hearing and are asking for additional time.

Looks like a “Slam Dunk” now…But, I still don’t know how they will get evicted from the “Whitehouse”…Do we need to organize a “Vigilante'” group to evict them and escort them to the “Tar & Feathering” area?

Blessings on this victory which comes during Passover and Holy Week..a good sign!
It certainly does more harm than good, however, when Karl Rove, today on Hannity radio program,WILLFULLY and deceitfully stated that one has to be “a citizen” to be president, and that “obviously, Obama is a citizen.”
With that Karl Rove and the RINOS became the equivalent of the Edsel…obsolete and unmarketable!

Orly, You have taken two steps forward, one back, over and over for so long that you have made immense progress where others would have given up. You have broken through what seemed an impossible barrier. This is rule of law vs. rule of man, truth vs. deceit, liberty vs. tyranny. Orly:…Each and every day now for the past 2 years or so, I’ve been praying that America will be guided and protected and that you will also be protected with a special shield, as we continue to move forward.
So on the 2nd of May, my prayers will also be with you. But I’m also praying that NO ONE…”NO ONE” will be allowed to interfer with (“YOUR case”)!!!!
Keep praying, Patriots, for a special protection for Orly and her family, to guide her and protect her from anything evil. I pray one or more times a day…for various things. So will be hitting this hard coming up!
